1. General conditions of Contract

2. Booking Process  and Contract Stipulation

2.1. Selecting a Property:  the Client may request information regarding the availability and price of the selected Property by sending via email the appropriate form ("Booking request") available on www.domuseuropa.com.

2.2. Making a reservation: Should the Client’s inquiry complying with the proposal of Domus Europa, Domus Europa will send to the Client a Reservation Code to insert in the form "Reservations". For acceptance, the Customer shall fill the form with all the missing data, underwrite and to send it to DomusEuropa within 24 hours from the reception. The Booking Confirmation sent out of the indicated terms will not be considered.

2.3. The Contract shall be deemed as made and entered into upon receipt by the Company of the Booking Confirmation undersigned in accordance with the provisions set forth in the foregoing art. 2.2. as well as the payment of the Booking Fee (or evidence of such payment).

3. Fees and payment

3.1. The Booking Fee is a down payment of the Full Rental Fee and is shall be paid at the moment of reservation, by credit card and Bank Transfer.

The Balance is the difference between the Full Rental Fee and the Booking Fee and it is due 7 days prior to arrival at the Property.

Extra or further Costs relate to our optional services such as, for example, daily cleansing or request of additional linens.

3.2. The Client will provide for the payment of the price of the Property under the terms and conditions set forth in the Booking Confirmation. For contracts with a duration exceeding one month, the fee is due in advance, at least 7 days before the beginning of the following month.

3.3. In case of delayed payments DomusEuropa may hand over the credit recovery practice to an external agency or a lawyer in order to obtain a payment injunction issued by a judge. Any procedural and legal costs in this regard will be charged to the Client.

4. Security Deposit: The Client shall be required to provide a Security Deposit in accordance with terms and conditions set forth in the Booking Confirmation.

The amount of the Security Deposit depends on the duration of the stay:

Duration of less than 15 days: €300

Duration of 15 days or more: €1,000

The security deposit shall be completely refunded within 5 working days of the termination of the Contract. However, DomusEuropa has the right to withhold the Security Deposit in full or in part for any damage owing to the Client, reserve the right to claim compensation for any further damage caused.

5. Duration, termination and cancellation

5.1. The duration of the contract will be indicated in the Booking Confirmation.

5.2. For contracts with a duration exceeding one month, the Client may choose the FLEXI contract which is renewed on a monthly basis. The renewal of the contract will be tacit and may continue up to a maximum of 12 months, unless the contract is terminated by either party by means of a 21 days written notice. In the case of a delayed notice, payment will be required for a 21 day period following the date in which the termination notice was received.

5.3. Should the Client cancel the reservation prior to the check in date, the Company will be entitled to retain the Booking Fee as set forth in the Booking Confirmation. In case of cancellation less than 48 hours before the check in date, the DomusEuropa will be entitled to retain the Full Rental Fee.

6. Arrival and departure

6.1. The keys to the Property will be given on the spot to the Client by the Company's appointee, at such location and time as agreed by prior arrangement. Check in and check out may take place between 09:00 a.m. and 07:00 p.m. from Monday to Friday. In the case of the Client's delayed arrival, check in will not be guaranteed after 11:00 p.m.

6.2. The apartment is available after 03:00  p.m. of arrival day, and must be left by 10:00 a.m. of departure day.

6.3. Upon handing over the keys of the Property, DomusEuropa may provide the Client with a form containing a brief description of the conditions of the Property, its appurtenances, annexed property, items and facilities contained therein at that date. The Client agrees to undersign the said form, without prejudice to his right to supply in writing any observation or comment.

7. Obligation of the Client

7.1. The Client agrees that the maximum number of people entitled to occupy the Property is that set forth in the Booking Confirmation. Non-compliance with this obligation shall entail payment to DomusEuropa of a penalty equivalent to 30% of the overall price for the Property for each additional person. At check in the Client it will be requested to show a valid identification document (or a copy).

7.2. The Client explicitly declares that each occupant of the Property complies with all legal requisites and regulations regarding residing in the territory of the Italian State, as specified by the law, either by being an Italian citizen or – in the case of foreign citizens – by having all the necessary visas and permits required for entering and residing in the country. The Client hereby assuming full responsibility for possessing and providing all required documents.

7.3. The Client undertakes to exercise due care and diligence in using the Property, and to keep it clean, refraining from any act which may damage the Property and/or cause damage to appurtenances thereof and/or annexed property and/or facilities contained therein.

7.4 The Client agrees not to cause any noise or nuisance to the disturbance of nearby residents. The use of the Property for illegal purposes or for prostitution is strictly forbidden.

7.5. The Client undertakes to return the keys of the Property in such manner as will be agreed with DomusEuropa.

7.6. The Client agrees not to reproduce and/or give to third parties the keys of the Property and/or reveal to third parties any access codes for the Property. The loss/damage of keys and/or locks will entail compensation of the cost of new locks and of 5 sets of keys.

7.7. The Client also agrees to take care and adopt the necessary safety measures to avoid unauthorized persons from accessing the Property for the entire duration of the lease as set forth in the Booking Confirmation. In the case of failure to comply with this obligation, the Client shall be liable to DomusEuropa for any damage caused to the Property and/or items contained therein.

7.8. The Client cannot sublease  or rent the the whole Property or a part of it. Non-compliance with this obligation shall cause the right to cancel the rental contract.

8. Right of access to the Property. DomusEuropa and/or any third parties appointed by DomusEuropa, identifiable upon request by the Client, shall have access to the Property to carry out any necessary repair and/or maintenance work. The Client will receive prior notice thereof, except in the case of an emergency. The Client undertakes to authorise visits to the Property for up to 4 hours a week if the Property has been put on the market for sale by the owner.

9. Prohibitions

9.1. Client is not allowed to have pets of any kind in the Property.

9.2. Client is not allowed to smoke inside the Property.

10. Suspension of utilities. DomusEuropa will not be liable to the Client for any suspensions or interruptions of the electricity and/or gas and/or water supply and/or Internet connection for reasons beyond its control.

11. Expressed resolutive clause

11.1. DomusEuropa may decide to resolve this Contract by sending the Client written notice via fax, in any of the following events:

a) should the Client fail to pay the Booking Fee in accordance with the terms set forth in the Booking Confirmation or

b) should the Client fail to pay the Balance in accordance with the terms set forth in the Booking Confirmation or

c) should the Client fail to pay the Security Deposit set forth in the Booking Confirmation, pursuant to the terms and conditions set forth therein or

d) should the Client's conduct be contrary to taking due care of the property (see art. 7).

11.2. In the cases designated by letters b) and c), DomusEuropa will be entailed to retain, by way of penalty, the Booking Fee previously paid by the Client in accordance with the provisions set forth in the Booking Confirmation.

12. Limitation of liability. It is understood that, within the limits provided for by law, the amount of any compensable damage due to the Client will not exceed the amount actually paid by the Client to DomusEuropa under the contract.

13. DomusEuropa liabilities. DomusEuropa will not be liable to the Client for any thefts perpetrated, with or without break-in or physical damages.

14. Personal data. The Client authorises DomusEuropa to communicate his personal data to third parties in order to comply with any obligations under the lease contract (Italian law decree 196/2003).
